    Effect of Installment Payment of Severance Pay
    and Related Cases
     

     
    1. Introduction
    Recently, a client entrusted us with the case of non-payment of severance pay due to the installment payment agreement on severance pay, and so I would like to review the relevant regulations and judgment criteria in detail. In this case, an employee had worked at a firefighting equipment company (company) from October 2019 to April 2021. When he requested severance pay when resigning, the company told him that there has no obligation to pay severance pay as the company has paid 10% of the monthly salary as severance pay according to the severance installment agreement. When signing an employment contract with employees, the company handed out two separate documents and received signatures. One is the application for monthly installment of severance pay, and the other is a pledge. The content of this pledge includes a request for prepayment of the amount of the severance allowance equivalent to the employee's service year, and agrees to offset this prepayment with the severance pay owed by the employee. These documents were attached documents to the employment contract that all employees were required to sign during the hiring process.
     
    The employee in this case agreed as a pledge on the fact that the equivalent of the severance pay was paid in the form of prepayment and replaced with the severance pay. The below questions arise regarding this case: ¨çcan the amount received in the form of preliminary payment be offset against the severance pay? ¨èCan the employee receive the severance pay if he submits a petition to the Employment and Labor Administration Office that the employee has not received the severance pay due to non-payment of the severance pay? ¨é Is the prepayment received monthly from the company in the form of prepayment in accordance with the installment agreement of the severance pay the unfair gains received without grounds from the company or the ordinary wage as he received from the company on regular and fixed basis?
    In this regard, I would like to look at the relevant cases in the court rulings and find the answers to the above questions.
     
    2. Classification of the Severance Pay by Installment Agreement and the Interim Settlement of Severance Pay
     
    A. Severance pay by installment agreement

    The severance pay by installment agreement is an agreement between the employer and employees to pay a certain amount as severance pay in advance, along with monthly wages or daily wages paid every day. It has a similarity with interim settlement of severance pay in that it receives severance pay in advance. However, the fundamental difference is that the installment payment of severance pay is received in advance in the form of pre-paid severance pay that has not yet occurred, and the severance pay will not be paid at the time of resignation. On the other hand, the interim settlement of severance pay is to receive pre-payment of severance pay that was accrued in return for previous work even before resignation as severance pay.

    B. Interim settlement of severance pay

    In principle, severance pay is a post-paid wage as a wage incurred when an employee resigns from work according to Articles 8 (Severance Pay System) and Article 9 (Payment of Severance Pay) of the Workers' Retirement Benefit Guarantee Act (hereinafter referred to as the 'Retirement Benefit Act'). Even in precedents, severance pay is a deferred payment that is incurred only when an employee resigns, and it is guaranteed as a mandatory law so that the right to claim severance pay cannot be given up.
    Since severance pay is accrued for resignation, it does not occur before resignation. The severance pay system is a system in which the average wages of 30 days or more for one year of continuing work is paid as severance pay to a resigning employee, and the severance pay is a statutory wage (Article 8 (1) of the Retirement Benefit Act). Therefore, the severance pay cannot be replaced with the installment payment of severance pay in advance, but at the request of the employee before the employee resigns, the employer may pre-settle and pay the severance pay for the employee's continuing working period (Article 8, Article 2 of the Retirement Benefit Act).
     
    3. Criteria for Judgment on the Severance Pay by Installment Agreement

    A. The Supreme Court's decision
    (May 20, 2010: 2007da90760)
     
    (1) Facts and progress of the lawsuits: The defendant is a company for business management consulting purposes, and the plaintiffs are the defendant's former employees, who did not receive severance pay due to the severance pay by installment agreement system. The company determined annual salary and severance pay through an annual salary contract, divided it into one-twelfth, and paid monthly salary and severance pay separately. In this annual salary contract, it was stated that "the employee requests the company to receive the severance pay on a monthly basis, according to his or her free will, and to pay it on a regular pay day."

    In this regard, the first trial ruled that the base benefit paid to the employees through the installment agreement on severance pay was ordinary wage and the severance pay by installment agreement was invalid. In response, the second trial ruled that the contract for the division of severance pay was invalid, but the amount in the name of the severance pay received by employees each month was an unfair benefit and should be returned. In response, the Supreme Court retained the ruling of the High Court, but limited the scope of the claim to be replaced with the severance pay to an amount equivalent to one-half of the severance pay benefit claim under Article 246
     
    (1) 5 of the Civil Execution Act.
     
    (2) Details of the Supreme Court decision: Since there had been different judgments regarding the severance pay by installment agreement, the principle was established through this Supreme Court Decision in 2010. First of all, the Supreme Court judged that ¨çwhether this can be valid as severance pay, ¨èwhether it was a wage or unfair gain, ¨éif this payment is a unfair gain, the company can offset it with other wages, and ¨êit is judged that it is only allowed to replace the amount exceeding 1/2 of the severance pay bonds at the time of adjustment.
     
    ¨ç Validity as severance pay: "The severance pay by installment agreement is a prior waiver of the right to claim severance pay that occurs when resigning, and is invalid because it violates mandatory laws. It has no effect as severance pay."
     
    ¨è Determination of wages or unfair benefits: "If the payment of severance pay is not effective, the employer was not obligated to pay the amount corresponding to the original severance pay. Therefore, the amount in the name of the severance pay already paid under the above agreement is not wage to be paid for the compensation for work. The employer suffered losses equivalent to the above amount by paying the amount in the name of severance pay to the employee without any legal cause, whereas the employee earned the same amount of profit. Therefore, the employee received the amount in the name of the severance pay from the employer as an unfair advantage. So, it is reasonable from the standpoint of fairness to see that it should be returned."
     
    ¨é Replacement by the employer in case of unfair gain: "In the case of overpayment of wages due to an error in calculation, etc., the employer may replace the claim for return of the overpaid wages from the wage bond or severance pay bond of the employee. This rule also applies when the employer has already paid the amount of severance pay to the employee, but it is not effective as payment of the severance pay, and the employer has the same amount of unfair benefit return claim, which is replaced with the employee's severance pay claim."
     
    ¨ê When replacing, only the portion that exceeds one-half of the severance pay bonds is allowed: "Under the Civil Execution Act, the amount equivalent to half of the severance pay and other benefit bonds with similar properties is stipulated as a non-seizure bond (Article 246 (1) 5). In the case of replacing the unfair gain return bond equivalent to the amount paid by the employer in the name of severance pay with the employee's severance pay bond, it is allowed only for the amount equivalent to more than one-half of the severance pay bond.
     
    B. Critical views on the Supreme Court ruling
     
    ¨ç Validity as severance pay: As the employer and the employee make an installment agreement in lieu of the severance pay and if such prior payment is paid as severance pay even though no severance pay is incurred, the severance pay is not paid at the time of resignation. If the right to claim severance pay is waived in advance, this is a violation of compulsory laws. It can be argued that the employer has paid the severance pay by installment agreement through labor-management agreement in order to reduce the burden of paying a certain amount of money upon resignation or retirement of employees. However, since the retirement pension system was introduced from December 2005, the defined contribution retirement pension system was introduced, it is possible to prevent future payments by depositing the amount equivalent to a certain severance pay each month in the financial facilities. Therefore, it is not persuasive for an employer to introduce the severance pay by installment agreement using the superiority of power when signing an employment contract.

    ¨è Determination of wages or unfair gains: In judging whether the amount paid in the name of severance pay is wages or not, the Supreme Court regarded it as unfair gains, not wages. Here, if the amount that is not recognized as severance pay is paid regularly and fixedly to employees, it can be regarded as ordinary wage. In December 2013, the Supreme Court's decision in the Supreme Court of ordinary wage decided that if a monthly fixed monthly wage was paid to all employees regardless of the name of the wage, it should be regarded as ordinary wage. Therefore, it is not convincing to argue that the amount paid in advance in the name of severance pay is not a reward for work, but as other money and goods, and that it is not wages but unfair benefit. The fixed amount paid monthly in the name of monthly severance pay should be regarded as a regular wage because it is the regular and fixed amount of money paid because employees have worked.
     
    ¨é Replacement by the employer in case of unfair gain: The Supreme Court said that even though the severance pay by installment agreement was invalid, the installment payment of the severance pay was made for the purpose of good faith. It was judged that it could be replaced with the employee's severance pay bonds. However, it can be seen that the installment payments due to the installment agreement on severance pay was abused as a means to not pay severance pay for the purpose of evil. When the retirement pension system is introduced, monthly severance pay can be deducted in lieu of the severance pay. Therefore, installment payment of severance pay cannot be recognized as a severance pay. Therefore, we do not believe that the bonds paid under the installment agreement for severance pay cannot be replaced with the bonds of severance pay.

    ¨ê When replacing, only the portion that exceeds one-half of the severance pay bonds is allowed: The Supreme Court considers the amount paid by the installment agreement for severance pay as unfair gains, and based on the provisions of Article 246 (1) 5 of the Civil Execution Act, the employer stipulates that the amount equivalent to half of the benefit receivables can be replaced with the severance pay receivables. The purpose of the above Civil Execution Act is a legislative consideration that protects the debtor from social policy considerations and maintains the standard of 1/2 of the severance pay bonds in terms of harmonization with the interests of the creditors. However, since the principle of paying full wages under Article 43, (1) of the Labor Standards Act is a special law of the Civil Act and is a claim arising from the employer's illegal severance pay by installment agreement, it cannot be replaced from the employee's severance pay claim because it cannot be effective as a severance pay.
     
    4. Revision of the Related Law and Changes in Major Precedents after the Ruling of the Relevant Supreme Court Ruling

    A. Legislation prohibiting abuse of the interim payment system for severance pay

    In many cases, the interim settlement system for severance pay was overrun, threatening the retirement life of employees. Accordingly, on July 25, 2011, the Retirement Benefit Act was revised to strictly limit the requirements for interim settlement of severance pay. Employers must pay the interim payment of severance pay for following 7 reasons: ¨çpurchase of a house, ¨èuse of the key deposit money for leasing a house, ¨émedical care needed for a disease that requires medical treatment for more than 6 months, ¨êbankruptcy of the employee or ¨ëindividual rehabilitation procedures initiated, ¨ìintroduction of the wage peak system, and ¨ídamages from a disaster. When an employee requests a severance pay before retirement and the employer permits it, the interim payment of severance pay could be paid only for above 7 reasons. Therefore, the partial payment of severance pay, which replaces the severance pay at the time of resignation / retirement by giving up the right to claim the severance pay at the time of retirement or by paying the severance pay in advance, is invalid because it violates the mandatory Labor Standards Act.

    B. Recent precedents related to the installment payment of severance pay

    (1) Daegu District Court ruling on October 26, 2012: 2012na11028: The claim is "The company signed an annual salary system contract with the employees and received a pre-payment agreement for severance pay from the employees. The company calculated the annual salary including severance pay, divided it by 12, and paid it to the employees every month. Since the company has already paid all the severance pay, there is no obligation to pay the severance pay to employees again."

    (2) Busan District Court ruling on October 16, 2012: 2012gadan28710: The claim is "The employees signed an employment contract with the company at the beginning of each year, including the amount of severance pay for the next one year, and the company paid the amount of severance pay accordingly. If the above payment is not recognized as a payment of severance pay and is not effective as a wage payment prescribed by labor-related laws, employees must return the above amount to the company as an unfair benefit."
     
    Judgment on (1) and (2) above: The court stated, "If the effect of the payment of severance pay is not recognized due to violation of compulsory laws and regulations even though the employer has actually paid the employee the amount of severance pay, the amount in the form of severance pay received by the employee is an unfair benefit and must be returned to the employer. However, in view of the legislative purpose of stipulating the severance pay system as a mandatory law, although the agreement concluded between the employer and the employee only sets wages, the employer took the form of an installment agreement only in order to escape the payment of the severance pay. In such case, the above rule cannot be applied." Therefore, it was judged that replacing with the severance pay was not allowed.

    (3)Supreme Court ruling on October 11, 2012: 2010 da 95147: The installment agreement on severance pay to avoid the payment of severance pay is ineffective as the payment of severance pay, and the amount equivalent to the paid severance pay cannot be regarded as unfair gain, so no return cannot be sought.

    5. Conclusion
    In 2010, after the Supreme Court's ruling that the severance pay paid under the installment agreement on severance pay was unfair benefit and that the amount equivalent to 1/2 of the employee's severance pay bond could be replaced with this unfair benefit claim , strict restrictions on interim settlement of severance pay were enacted in 2011 in order to protect severance pay bonds. Accordingly, interim settlement of severance pay has become virtually impossible except for seven reasons. In particular, in December 2013, the Supreme Court's decision was made as ordinary wages on various allowances that are fixedly paid in various names. Due to such a tendency of legislation and precedents, installment payment of severance pay is not recognized as severance pay or unfair benefit. The pre-payment method of severance pay due to the installment agreement of the severance pay mentioned at the introduction part of this article will no longer be recognized as interim settlement of severance pay or unfair benefits of employees.
